Who we are and what we provide

Ecktivate, part of CWLR Holding, based in Assendelft, the Netherlands. We provide the Ecktivate Platform: software that helps organisations run their sales and marketing, supported by AI agents that draft proposals for humans to approve.

These terms apply to the use of this website and the platform, unless we agree otherwise with a client in writing. In case of conflict, the client agreement prevails.

Access and accounts

Access to the platform runs through a personal account issued by or on behalf of the client organisation. Keep your credentials to yourself and report (suspected) misuse immediately.

We may suspend access in case of misuse, security risks or non-payment, after notifying you first where reasonably possible.

Using the platform

The platform supports commercial communication on behalf of the client. The client remains responsible for its content and lawfulness, including honouring opt-outs and the rules on unsolicited communication in the countries where the client operates.

Every outgoing message requires human approval in the platform, unless the client explicitly configures a higher degree of autonomy. Using the platform for spam, deception or processing data without a legal basis is not permitted.

Connected services

Clients can connect their own third-party accounts, such as Google (Gmail, Calendar, Analytics, Ads), LinkedIn or other integrations. Such connections are optional and revocable at any time; our privacy statement applies to the data processed through them.

The terms of the respective provider additionally apply to connected services. We are not responsible for changes, outages or restrictions on the provider's side.

Data and privacy

How we handle personal data is described in our privacy statement. For data we process on behalf of a client we enter into a data processing agreement on request.

All client data remains the property of the client. At the end of the agreement we hand it over on request and delete our copies within a reasonable period.

Availability and changes

We do our best to keep the platform continuously available but do not guarantee uninterrupted operation. Where possible we announce maintenance in advance.

We develop the platform continuously; functionality may change. We announce material changes to these terms; continued use of the platform after that means the new terms apply.

Liability

Our liability is limited to direct damages and to the amount the client paid us in the three months preceding the event causing the damage. We are not liable for indirect damages, such as lost revenue or loss of data caused by circumstances beyond our control.

Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district of Noord-Holland, the Netherlands.
